Investigators from the Medical Board of California arrested Cary Silberman at his home in San Jose on Tuesday for practicing medicine without a license. Silberman is the owner of Shiny Toes, a spa that advertises laser treatment for toenail fungus in San Ramon, San Francisco, Beverly Hills and San Jose. the medical board began investigating Silberman this January after an undercover investigator, posing as a patient, obtained evidence that he was diagnosing and treating toenail fungus and using lasers to treat this ailment. Laser treatments are considered a medical procedure and can only be performed by a licensed physician; Silberman is not licensed to practice medicine in California and is listed as Shiny Toes’ homeopath director. In June investigators searched Silberman’s San Jose home and offices in San Ramon and San Francisco. Investigators from the office of safe medicine checked the Beverly Hills office and found it is no longer in business. Medical board investigators were then able to get the Santa Clara County District Attorney to issue a criminal complaint and a warrant. Silberman is in custody in the Santa Clara County jail, pending $200,000 bail. the investigation is ongoing. Silberman and Shiny Toes representatives did not return calls for comment. “The mission of the Medical Board is public protection, and this action reflects the board’s ongoing commitment to that mission,” said Linda Whitney, executive director of the medical board.
